These Terms of Service ("Terms") govern your access to and use of the Aesthetics By Gino website, application process, and coaching services (collectively, the "Services"), provided by Gino ("we," "us," "our," or "Coach"). By submitting an application, becoming a client, or otherwise using our Services, you agree to be bound by these Terms.

1. Eligibility

Our Services are intended only for individuals who are at least 18 years of age. By using our Services, you represent that you meet this age requirement.

2. Description of Services

We provide one-on-one online fitness and nutrition coaching, including personalized training programs, nutrition guidance, check-ins, and access to a coaching app for tracking your program. Applications are reviewed personally, and acceptance into the program is at our discretion.

3. Health and Fitness Disclaimer; Assumption of Risk

Participation in any fitness, exercise, or nutrition program carries inherent risks, including but not limited to the risk of physical injury, aggravation of a pre-existing condition, or in rare cases, more serious harm. You should consult a physician before beginning any new exercise or nutrition program, particularly if you have any pre-existing medical condition, injury, or health concern.

By enrolling in or using our coaching Services, you voluntarily assume all risks associated with participation, including risks that may arise from your own negligence, the negligence of others, or the condition of any equipment used. You acknowledge that you are participating voluntarily and are solely responsible for your own health and safety while following any program, exercise, or nutritional guidance we provide.

You agree to inform us promptly of any pain, discomfort, or symptoms experienced during training, and you agree to stop any activity that causes pain and to seek appropriate medical attention if needed. We are not responsible for your failure to disclose relevant health information or to follow this guidance.

4. Not Medical Advice

Our Services are educational and coaching in nature. We are not physicians, registered dietitians, or licensed medical providers, and nothing we provide — including training programs, nutrition guidance, or feedback — constitutes medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition.

5. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information about your health, goals, and circumstances during the application process and throughout coaching.
• Use good judgment and stop any activity that causes pain, dizziness, or discomfort.
• Use the coaching app and any equipment appropriately and safely.
• Communicate honestly and promptly about your progress, challenges, and any changes in your health.

6. Payment, Commitment, and Refund Policy

Coaching is offered under fixed-term commitments. Once you enroll in a term, you are committed to that full term. All payments are final and non-refundable, including in the case of early cancellation, discontinued use, or failure to complete the program. Please review your chosen term carefully before committing, and reach out with any questions prior to enrolling.

7. Intellectual Property

All training programs, nutrition plans, written materials, and other content we provide to you as part of our Services are for your personal use only. You may not resell, redistribute, or share this content with third parties without our prior written permission.

8. Limitation of Liability

To the fullest extent permitted by law, Aesthetics By Gino and Gino personally shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of, or inability to use, the Services. To the fullest extent permitted by law, our total liability for any claim arising from or related to the Services shall not exceed the amount you paid for coaching in the three (3) months preceding the claim.

Nothing in these Terms is intended to limit liability for gross negligence, willful misconduct, or any liability that cannot be limited or excluded under applicable law.

9. Disclaimer of Warranties

Our Services, including any training programs, nutrition guidance, and the coaching app, are provided "as is" and "as available," without warranties of any kind, either express or implied. We do not guarantee any specific results, including but not limited to weight loss, muscle gain, or any particular fitness outcome. Individual results vary based on many factors outside our control.

10. Indemnification

You agree to indemnify and hold harmless Aesthetics By Gino and Gino personally from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any rights of a third party.

11. Termination

We reserve the right to discontinue coaching services to any client at our discretion, including for failure to follow program guidance, abusive conduct, or breach of these Terms. Termination of services by us for cause does not entitle you to a refund of any amounts already paid.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Ohio.

13. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last updated" date. Continued use of our Services after changes are posted constitutes acceptance of the revised Terms.
